YouTube and Dailymotion: 1st distribution on 5 April 2011

Sacem signed agreements with YouTube and Dailymotion those last two years. They marked the beginning of its relationships with websites of the like, extensive users of musical works. They reaffirm the principle of remunerating creators and publishers on the Internet.

And your rights?

For the first time, Sacem is going to distribute rights for this broadcasting sector. The period in question is 2006 to 2009, the days when such websites were starting to develop.

This sector's economy may still only be in its very early stages, the volumes to be processed considerable (2.5 billion videos available in 2009), and the rights for this period only modest, but it's only the beginning!

Given the above and given the lack of usable broadcasting data, Sacem's Board of Directors' has decided to use distributions made by Sacem between 2006 and 2009 as the basis for distributing the authors' rights collected from these websites. It was the Board of Directors' intention to take a decision that reaffirmed the principle of authors' rights on Internet and that accurately reflected the very general nature of repertoires accessible on YouTube and Dailymotion, without bumping up the cost of distribution.

The calculation

The distribution will be made by right holder (not by work)

To trigger the allocation of rights, a minimum threshold must have been reached in distributions operated by Sacem in performing rights and in phono/mechanical reproduction rights between 2006 and 2009. This threshold applies to each of the four years in question; it only needs to be reached or exceeded in one of the years for the allocation of rights automatically to be triggered.
The amount distributed to the right holder is then calculated proportionally to the distributions s/he received during the years 2006, 2007, 2008 and 2009.

To note: Humorists and video clips directors

Due to the special exposure of sketches and video clips on these websites, Sacem's Board of Directors decided to reserve 5% of the total amount to be divided among the authors of sketches and the directors of video clips, in proportion to these Sacem members' distributions.

And for 2010?

YouTube and Dailymotion have pledged to hand over files containing consumption data.
After checking that the data can be used, Sacem must ensure that distribution per act is possible, at what price and up to what threshold. Watch this space…
