Compulsory References for Videos

No matter what the content of the recording is, how it is used or the type of licence issued, any videocassette or DVD must print the compulsory references as specified below and in the general provisions of the licence application forms. Any inaccuracy in or omission of these references may constitute an infringement of the moral rights of the rights-holders for which the producer will be held liable.

Without citing the producer’s own references, the following details must be marked:

On the recording and the sleeve:

  • the SDRM logo, when all or part of the recorded works are administered by SDRM
  • the reference, i.e. the digital or alphanumerical identification number allocated by the producer (this must be the same number as on the licence application)

On the sleeve:

  • the full titles of all the works reproduced
  • the name of the director of the audiovisual work, the composer, the author, the text adapter and the music arranger (when the adaptation and/or arrangement are/is authorized) plus, if applicable, the names of the scriptwriter, dialogue writer and publisher
  • the compulsory reference “tous droits du producteur vidéographique et du propriétaire de l’oeuvre enregistrée réservés. Sauf autorisation, la duplication, (la location ou la vente selon les cas) le prêt, l’utilisation de ce vidéogramme pour exécution publique et radiodiffusion sont interdits” [The video producer and owner of the recorded work reserve all rights. Unless otherwise authorized, no duplication (rental or sale), lending, or use shall be made of this video recording for the purpose of public viewing or radio broadcast.]
  • the compulsory reference “Interdit à la vente” [Not for Sale] for any recordings distributed free of charge

Obligations to authors and composers

What obligations do you have to the authors and composers of works you wish to reproduce? In compliance with article L.112-4 of the French Intellectual Property Code, before reproducing protected works prior authorization must be obtained from the author or his rights-holders. Such authorization covers two types of rights:

Rights for the reproduction of musical performances:
SDRM administers reproduction rights for works with member societies (SACD: dramatic works – Sacem: works of music – SCAM: television works and documentaries), covering musical performances. A licence application must be lodged with SDRM following the conditions detailed below.

Rights for the reproduction of the lyrics and/or score of the work:
These rights are held by the music publisher.

SDRM may be delegated by certain publishers to act on their behalf, granting or refusing authorization for the lyrics and/or scores of works in their catalogue to be reproduced.

Producers of MIDI files must also apply the criteria set in the Charter for MIDI Producers, drawn up jointly by the professional associations representing music publishers in France (CDSEM and CEMF) and the professional association of computerized phonogram producers (SPPI). The charter is available on the site.
