Definitions

Sacem Repertoire
The repertoire is comprised of works of music, with or without lyrics, in France or another country, included in the repertoire either through direct initiatives by members, or through reciprocal agreements concluded between SACEM and societies of authors outside France. Also included, and under the same conditions are:

  • poems and sketches
  • documentary works on a solely musical subject
  • excerpts from dramatic works and musical dramas running for less than 20 minutes on television or 25 minutes on radio
  • dubbing and sub-titling of foreign films
  • the making of films or videos related to works in Sacem repertoire, in particular video clips
Music in the General Repertoire
These are works of music which are managed by Sacem and are not commissions or sound library music. SDRM authorization is granted after the producer has obtained prior written authorization from the rights-holders (usually the music publisher) whose details are available from the General Documentation & Distribution Department:

Existing Music
These are works which have already been released, performed or presented. They can be from one of two sources:
 

  • from a record or cassette of sound library music or a commercial release
  • a recording made at the request of the producer for his/her film/video, or of a recording made when shooting (an actor performing theme music or a song)
Sound Library Music
Some thirty companies offer recordings specially edited and released for soundtracks of films and videos, and containing a wide range of orchestrations and beats. When the producer reproduces works from these catalogs, these recordings are automatically approved for authorized use. SDRM can then issue the license for reproducing the works covering the authors’ rights.
Music “Commissions”
These are musical compositions with or without lyrics made specifically for the film or video (CPI - article L.113-7). Payment is made for the commission and the agreement between the producer and composer (and author for a work with lyrics) formally reserves reproduction and public performance rights for the original work which the composer (and if applicable, the author), when a member of the society, has Sacem administer. The composer (and author) registers the work with Sacem, at the General Documentation Department:

Others Repertoires

SCAM (multimedia authors)      

SCAM repertoire includes works by authors who are members of SCAM, thereby having their rights managed by SCAM, and for publishers, operating under mandate, either directly or through the memorandum of agreement concluded with SCELF (the French society for literary publishing).

The works concerned are:

  • documentary-type films, videos (for television or film release) and audio works:documentaries, reports, evocative works, stories, portraits etc - news magazine productions (e.g. news, cultural or scientific content)
    corporate films/videos - new visuals (e.g. original videos, computer-generated pictures, computer graphics and animated collages)
  • interactive multimedia works released on CD-ROMs, DVDs, networks etc.
  • written works: literature, journalism, scientific texts etc.
  • still pictures: photographs, illustrations, cartoons etc.
SACD (dramatic composers and authors)      

The repertoire is comprised of works by members whose rights are managed by SACD, either by mandate or by transferal, in compliance with the conditions set in SCAM statutes, as well as works managed for certain territories for societies of authors outside France.

The works concerned are:

  • dramatic works: plays, musical comedies, operas, choreographic works, pantomimes, circus acts and tricks
  • audio & audiovisual works: films, television programs, multimedia works, radio productions
  • pictures: photographs and works made using analogous techniques.

Related Rights

These are rights related to authors’ rights as recognized under the French Code on Intellectual Property (Book II) for performing artists, audio and video recording producers and communication companies making audiovisual productions.
