Remember that sending a licence application systematically triggers the billing process (no estimate is drawn up) for protected works belonging to the repertoires we represent.
Useful information: it should take approximately ten days (non-contractual estimation) from the time of reception of the licence application to the issuing of the la debit note. As soon as payment is received, a copy of the licence application specifying “Bon pour autorisation” (Licence granted) is then returned to the producer and another copy is sent directly to the manufacturer (presser).
On reception of the licence application
The licence is non-exclusive and concerns only mechanical reproduction rights for authors, composers and publishers or their right holders, as defined in the Code de la Propriété Intellectuelle (Intellectual property code).
Only protected works belong to repertoires managed by SDRM (SACEM, SCAM, SACD) are taken into account in calculating royalties:
SDRM is not concerned with the licensing of the following works:
- works in the Public Domain (DP),
- works not identified by SDRM (grouped under the term “Owner unknown at present” or PAI), or
- works it does not represent (in which case the licence for reproduction must be obtained directly by the producer).
In these cases, the licence application is returned to the producer, specifying that it is in the “Public Domain” or “Owner unknown at present”.
Payment
In exchange for payment, the licence is granted and the producer receives a copy of the request, with the indication: “Bon pour autorisation” (Licence granted).
The producer can then proceed with the pressing or duplication of media by the manufacturer for the amounts specified in the request.
SDRM sends a copy of the licence directly to the manufacturer.
