The film has been made and you want it to be released/broadcast
In France
It is usually the outlet or broadcaster (e.g. movie theater or television channel) that pay the fees for performance rights due directly to Sacem. The amount is then divided between all the authors and publishers of the different works of music on the film soundtrack.
The fees are calculated as follows:
- For commercially released films screened in movie theaters, authors receive a percentage of the ticket sales (excluding VAT). The rate is 2% or 1.5% for theaters in a professional association affiliated with the FNCF [Fédération Nationale des Cinémas Français] or UNSCF [Union Nationale Syndicale des Cinémas Familiaux].
- For music used in advertisements screened in movie theaters, the public performance rights due are paid directly to Sacem by the advertising agency circuits (e.g. Circuit A or Médiavision).
Outside France
When a film is released outside France in a country where no direct fee is charged to movie theaters by a society of authors collecting rights for music authors and composers, the exporting producer must pay Sacem a fee calculated as 3. of the sales price or leasing fee charged for the film.
For producers who are members of the CSPEFF [Chambre Syndicale des Producteurs et Exportateurs de Films Français] or UPF [Union des Producteurs de Films] the fee is 2.5 %.
